We have managed a wide range of personal injury cases during our decade in practice. We understand that no two cases are exactly alike and that each one requires a personalized approach. Below are some of the common types of personal injury cases we manage in Mustang, OK.
Motor Vehicle Accidents
Motor vehicle accidents are often the product of irresponsible and careless driving, such as texting, speeding, and ignoring road signs. Collisions may also occur because of defective auto parts that fail during operation, like tires, brakes, or steering columns. Our attorneys know how to investigate a collision thoroughly to understand what happened, who’s to blame, and what resources can provide compensation.
We are prepared to handle a wide range of such cases, including:
Slip and Fall Accidents
Private residences, businesses, and public property may have hazards that can cause visitors to slip and fall. Property owners and occupiers have a duty to minimize risk on their premises and can be liable for any falling injuries due to known hazards. For instance, if a business owner doesn’t put up a wet flooring sign, they can be financially liable if a customer falls on recently mopped tiling.
Medical Malpractice
Medical professionals like doctors, chiropractors, and nursing home professionals must provide their patients with a sufficient standard of care. Negligent or abusive medical staff can cause severe injury or exacerbate existing illnesses. If you’ve suffered harm due to negligent care from a medical professional, you can file a medical malpractice claim to recover your losses. Unlike many other states, Oklahoma has no caps on compensation in medical malpractice claims.
Dog Bites
If you have injuries from a dog bite, you can file a claim against the owner for financial compensation. Dog owners in Oklahoma are strictly liable for bite injuries, meaning victims do not have to demonstrate negligence or the dog’s violent tendencies to recover compensation (Ok. Stat. 4-42.1).
Product Liability
When companies allow defective or otherwise unsafe products onto the market, they can be held liable when those products cause injuries to consumers. Common examples of defective products include electronics, pharmaceuticals, appliances, children’s toys, and furniture. Products may be defective due to manufacturing errors, dangerous designs, or insufficient warnings.
Wrongful Death
Losing a loved one is a devastating experience, financially as well as emotionally. If your loved one passed away as a result of someone else’s harmful behavior, we can help you file a wrongful death claim against that party. Through a claim, you can recover money for both the personal and the economic harm you’ve suffered because of your loss.
Depending on the circumstances of your case, you could be entitled to compensation for the following:
If the at-fault party’s behavior was egregious enough, a court might also award punitive damages as punishment. However, courts do not award these damages often, and state law places a cap on their value (Ok. Stat. 23-9.1).
In many personal injury cases, the blame lies squarely on the defendant. However, injury victims sometimes share fault for their injuries. The good news is that injury victims can still recover money if they are partially at fault. Oklahoma uses a comparative negligence system that will reduce compensation according to the victim’s percentage of blame. For example, a victim who is 30 percent at fault in a case that resulted in an award of $100,000 award would receive $70,000—that is, the $100,000 minus their 30 percent of fault.
As a result, it’s important to work with an accomplished attorney who can argue to reduce shared liability and maximize recoverable compensation.
According to Ok. Stat. 12-95, you have two years from the date of an injury to file a lawsuit based on negligence. For intentional torts, such as assault or battery, the time limit is instead one year. In the case of hidden injuries, the time starts counting from the date you discovered the injury rather than the date you suffered it.
These time limits are extremely strict and have very few exceptions. If you try to file a lawsuit after the deadline on your claim has passed, the court will reject the claim, even if the opposing party is in the wrong. As such, the best option is to start as early as possible. The earlier you start, the better positioned you will be to pursue full compensation.
A single injury can completely derail your life and create enormous financial pressures. Farha Law, PLLC wants to lift these pressures from your shoulders. If your injuries were the product of someone’s irresponsible actions, you deserve compensation to facilitate your healing and recovery. We can stand up for your rights and protect your interests today, tomorrow, and beyond.
